תקנון הגרלה באתר מדטון-הדים 2021
“קופסאות ייבוש”
- מבוא
1.1 מדטון קמעונאות בע”מ (להלן – “מדטון-הדים”) מפעילת אתר “Medton-Hedim” מכריזה על הגרלה נושאת פרסים, שתתקיים באתר www.medton-hedim.co.il (להלן “האתר”).
1.2 ההשתתפות בהגרלה כפופה לתנאי תקנון זה.
1.3 המבצע ייערך בהתאם להוראות “הודעה בדבר מתן היתר כללי לעריכת הגרלות לפרסומת מסחרית לפי חוק העונשין, התשל”ז – 1977” (להלן: “ההיתר הכללי”), ויהיה כפוף להוראות תקנון זה.
1.4 ניתן יהיה לעיין בתקנון זה באתר האינטרנט בכל עת.
- כללי
2.1 בהשתתפות מקבל על עצמו המשתתף את תנאי תקנון זה וכן את תנאי תקנון אתר מדטון-הדים (בשינויים המחויבים). בכל מקרה של סתירה ו/או אי התאמה בין תקנון זה לבין כל פרסום אחר, מכל סוג ומין (לרבות תקנון אתר מדטון-הדים), יגברו הוראות תקנון זה והן אשר תקבענה. המודעות והפרסומים השונים הם לנוחות המשתתפים בלבד.
2.2 בהשתתפות בהגרלה מאשר המשתתף כי הוא מסכים לתקנון ההגרלה, וכן פוטר את קודקס מכל טענה, דרישה או תביעה הקשורה, במישרין או בעקיפין, עם ההגרלה, בלא יוצא מהכלל.
2.3 תקנון זה מנוסח, משיקולי נוחות בלבד, בלשון זכר. ההשתתפות בתחרות, בהתאם להוראות תקנון זה, מיועדת לגברים ולנשים כאחד. - פרשנות
3.1 בכל מקרה של אי התאמה ו/או סתירה כלשהי בין הוראות תקנון זה לפרסומים אחרים כלשהם בדבר המבצע, תגברנה הוראות תקנון זה לכל דבר ועניין.
3.2 כותרות הסעיפים ניתנו לשם הנוחות בלבד ואין לייחס להן כל משקל בפרשנות תקנון זה. - הגדרות
מבלי לגרוע משאר ההגדרות המופיעות בתוכנית זו, יפורשו המונחים הבאים בהתאם לאמור והוא כשאין כוונה אחרת משתמעת מתוכן העניין או מהקשר הדברים:
4.1 “ההגרלה” או “המבצע” – ההגרלה שתוכנית זו חלה עליה במסגרת מבצע “קופסת ייבוש חשמלית למכשירי שמיעה”. הגרלה אחת לזכייה בפרס, הנערכת על ידי עורכת ההגרלה, בהתאם להוראות התקנון ובהתאם להודעה בדבר היתר הכללי לעריכת הגרלות לפרסומת מסחרית לפי חוק העונשין – 1977.
4.1 “הפרס” – קופסת ייבוש חשמלית למכשירי שמיעה, יוגרל בחמישה הגרלות, לחמישה זוכים שונים מבין המשתתפים בהגרלה.
4.3 “משתתף” – משתתף בהגרלה הוא העומד בתנאי ההשתתפות המנויים בסעיף 5 שלהלן והינו תושב ישראל שגילו עולה על 18 שנה.
4.4 “עורכת המבצע” – מדטון בע”מ, ח.פ 515218600, רחוב התע”ש 6 תל אביב.
4.5 “תקופת המבצע” – התקופה האמורה בסעיף 6 שלהלן.
- אופן ההשתתפות בהגרלה והזכאים להשתתף בהגרלה
מבצע ההגרלה מקנה את הזכות להשתתף בהגרלה בתנאים המצטברים להלן :
5.1 “מועמדים לזכייה בפרס” – המשתתפים אשר מלאו את פרטיהם בדף ההגרלה באתר ואשר מלאו אחר התנאים המפורטים בדף ההגרלה.
5.2 משתתף אשר נכנס לדף ההגרלה כמפורט לעיל, והזין פרטי קשר כנדרש הכוללים: שם, שם משפחה, טלפון, וכתובת אימייל. ייחשב המשתתף כאילו הצהיר כי קרא את תקנון זה והוא מסכים לכל תנאיו.
5.3 ההשתתפות במבצע כרוכה בשימוש שירותי ההשמה של עורכת המבצע. בטרם הפנית המשתתף על ידי עורכת המבצע למעסיק ו/או פנית המשתתף למעסיק באמצעות עורכת המבצע, המשתתף יידרש לאשר את השתתפותו בהגרלה באתר עורכת המבצע.
5.4 הרישום להגרלה ייסגר בתאריך 1.10.21 בשעה 08:00, לכל משתתף אשר יזין את פרטיו בדף ההגרלה תהיה זכות אחת להשתתף בהגרלה.
5.6 לא ישתתפו בהגרלה עורכת ההגרלה, המפקחת, מנהליהם, שותפיהם, עובדיהם ובני משפחותיהם. ההשתתפות בהגרלה אסורה מתחת לגיל 18. - תקופת מבצע ההגרלה
6.1 החל מיום 1.09.21 ועד יום 1.10.21 (להלן: “תקופת המבצע”), נערכת באתר “מדטון-הדים” הגרלה העונה לשם “קופסת ייבוש חשמלית”.
6.2 עורכת המבצע שומרת לעצמה את הזכות לשנות ו/או להאריך ו/או לקצר את תקופת הפעילות ו/או לבטל את הפעילות, מכל סיבה הנראית לה כסבירה והולמת לעניין זה ובהתאם להוראות הדין ולא תשמע ו/או תתקבל כל דרישה ו/או טענה לעניין זה.
6.3 ההודעה על הפסקת מבצע ההגרלה, תפורסם באתר האינטרנט של “מדטון-הדים”
- שיטת ההגרלה
7.1 עורכת המבצע תדפיס את שמות המשתתפים אשר שלחו ומילאו את טופס ההשתתפות המקוון והעומדים בתנאי הזכאות להגרלה על גבי פתקים אשר ירוכזו בתיבה במשרדי עורכת המבצע.
7.2 במועד ביצוע ההגרלה יועלה בגורל שמו של הזוכה באמצעות שליפה ידנית אקראית של פתק מתוך התיבה, על ידי גורם שייקבע על ידי המפקח על ההגרלה. - פרסום תוצאות ההגרלה
8.1 בתום המבצע תכריז עורכת המבצע על שם הזוכה בהגרלה אשר יפורסם באתר מדטון-הדים בסמוך לאחר מועד עריכת ההגרלה. - אופן קבלת הפרס והודעה על זכייה בהגרלה
9.1 במהלך 5 ימי העסקים שלאחר ההגרלה תעשה עורכת המבצע ניסיון ליצור קשר טלפוני עם הזוכה בהגרלה ולהודיע לו על זכייתו.
9.2 עורכת המבצע תעשה מאמצעים סבירים לאתר את הזוכה בהגרלה באמצעות הפרטים כאמור, אולם לא תהיה מחויבת להעניק את הפרס במקרה בו לא תצליח ליצור עמו קשר, לאחר השקעת מאמץ סביר, וזאת עקב אי התאמה בפרטים ו/או תקלה טכנית ו/או בשל מסירת פרטים לא מעודכנים ו/או שגויים ע”י הזוכה ו/או במקרה שהודעת הזכייה לא תידרש ו/או תוחזר לעורכת המבצע, מכל סיבה שהיא. זוכה שלא אותר, מכל סיבה שהיא, לא יהיה זכאי לקבל הפרס ולא תהיה לו כל טענה כנגד עורכת המבצע בקשר לכך.
9.3 עצם ההשתתפות במבצע תחשב להסכמת הזוכה לפרסום פרטיו והזוכה מוותר בזאת מראש על כל טענה ו/או תביעה בקשר לכך. - אופן מימוש הפרס
10.1 עורכת המבצע לא תישא בכל אחריות בגין אי מימוש הפרס בגין סיבות התלויות בעקיפין ו/או במישרין בזוכה. האחריות על מימוש הפרס הינה על הזוכה בהגרלה בלבד.
10.2 עורכת המבצע לא תהיה אחראית לטיב הפרס ו/או כל פגם ו/או איכותו ו/או ליקוי אשר
יתגלה בו ו/או בכל חלק ממנו.
10.3 מבלי לגרוע מהוראות תקנון זה והוראות כל דין, עורכת המבצע תהיה רשאית שלא לאפשר את מימוש הפרס ע”י מי שזכה בו במעשה שאינו כדין ו/או במעשה עבירה.
10.4 הזוכה בהגרלה פוטר את עורכת המבצע ו/או כל מי מטעמה מכל אחריות לכל נזק ו/או
אי התאמה ו/או שיבוש ו/או חוסר שביעות רצון ו/או כל פגם אחר שיתגלה בפרס, ככל
שיתגלה. - המפקח
11.1 כמפקחת על ביצוע ההגרלה תשמש ולדה קלייב (להלן: “המפקחת”).
11.2 החלטת המפקחת בכל הקשור למבצע זה הינה סופית ומחייבת לכל דבר ועניין, והמשתתף, הזוכה בהגרלה ו/או כל משתתף במבצע מוותרים בזאת דרישה ו/או על כל טענה ו/או תביעה בקשר עם החלטת המפקח.
11.3 המפקחת תהיה אחראי לטיפול בפניות המשתתפים, להבהרות במקרה של אי הבנה, קושי או ספק, לרבות בפרשנות התקנון, וכן להכריע בכל מחלוקת בין עורכת המבצע למשתתפים במבצע, לרבות הזוכה בהגרלה ו/או לטוענים לזכייה.
11.4 תפקידי המפקחת הינם כמפורט בהודעה על מתן היתר כללי לעריכת הגרלות לפרסומת מסחרית.
11.5 המפקחת תמלא אחר הוראות ההיתר הכללי וידווח לרכז ההגרלות לפרסומת מסחרית במשרד האוצר כנדרש. - הצהרות המשתתף
12.1 המשתתף ו/או המבקש להשתתף במבצע מאשר, מצהיר ומתחייב בזאת כי הוא פוטר את עורכת המבצע ו/או מי מטעמה מכל אחריות לכל תביעה ו/או טענה ו/או נזק ו/או דרישה הקשורים במישרין ו/או בעקיפין במבצע.
12.2 בהשתתפותו במבצע מאשר, מצהיר ומתחייב המשתתף ו/או המבקש להשתתף במבצע כי קרא תקנון זה וקיבל על עצמו את הוראותיו, וגם אם לא קרא תקנון זה מסכים המשתתף ו/או המבקש להשתתף במבצע כי תקנון זה יחול עליו ויחייבו לכל דבר ועניין.
12.3 המשתתף במבצע ההגרלה מוותר על כל טענה ו/או תביעה כנגד עורכת המבצע ו/או נותני הפרסים לרבות בגין המבצע. - הגבלת השתתפות
13.1 ההשתתפות במבצע אסורה על מנהלי ועובדי עורכת המבצע ועל מפקחת המבצע, על בני משפחותיהם, וכן על כל מי שסייע לעורכת המבצע בעריכת המבצע. - אחריות
14.1 על הזוכה בהגרלה לממש את הזכות לפרס בתקופת תוקפו ובתנאים כמפורט בתקנון זה ובהתאם להנחיות עורכת המבצע. לא מימש הזוכה בהגרלה את הזכאות לפרס בפרקי הזמן ו/או בתנאים האמורים, יראו בכך כאילו ויתר על הפרס. במקרה כאמור, לא יהיה זכאי הזוכה בהגרלה לקבלת “שוויו הכספי” של הפרס ו/או לכל הטבה ו/או לאפשרות מימושו במועד אחר, הנחה או פיצוי חלופי, ולא תישמע ממנו כל טענה ו/או דרישה כלפי עורכת המבצע ו/או מי מטעמה בעניין.
14.2 ההשתתפות במבצע נעשית על אחריותו הבלעדית של המשתתף. עורכת המבצע ו/או מי מטעמה אינם אחראים לכל טענה בדבר הפרת הוראת כל דין ו/או לכל נזק ו/או הוצאה שייגרמו לזוכה בהגרלה ו/או לצד שלישי בקשר עם השתתפותו של משתתף כלשהו במבצע. ככל שעל אף האמור, עורכת המבצע או מי מטעמה יאלצו לשאת בהוצאה כאמור, ישפה אותם המשתתף הרלוונטי מיד עם דרישה.
14.3 ויתר הזוכה בהגרלה על הפרס ו/או לא התאפשר לו לממשו, מכל סיבה שהיא (לרבות, אך לא רק, בשל פסילתו על ידי עורכת המבצע ו/או המפקח ו/או אי עמידתו בתנאי תקנון זה), לא יהיה הזוכה בהגרלה זכאי לכל הטבה ו/או פרס ו/או פיצוי אחר מעורכת המבצע ולא תישמע מצדו כל טענה ו/או דרישה כלפי עורכת המבצע בעניין.
14.4 כל תקלה ו/או איחור ו/או שיבוש מכל סוג שהוא במבצע ו/או בעריכת ההגרלה מחמת כח עליון ו/או מחמת אירועים שאינם תלויים בעורכת המבצע, לא ייחשבו כהפרה של תקנון זה ולא יזכו את המשתתפים בהגרלה ו/או את הזוכה בהגרלה בכל סעד ו/או זכות.
14.5 עורכת המבצע ו/או כל מי מטעמה אינם אחראים ולא יהיו אחראים לכל טענה בדבר נכונות ו/או אי דיוק ו/או אי נכונות ו/או שיבוש בפרטים שנקלטו באמצעות טופס ההשתתפות.
